          UNLAWFUL-DETAINER SUITS    

                   (EVICTIONS) FOR LANDLORDS.

                          UNLAWFUL-DETAINER INFORMATION

•        Ms. Shelton handles residential and commercial unlawful detainer actions (evictions) to evict tenants and previous property owners, after a foreclosure or short sale.  She prepares all legal documents, evaluates the legal issues, and personally takes all phone calls.  This office is not an unlawful-detainer mill, and your case will never be touched by a paralegal.  At high-volume mills, the errors, delays, and misunderstanding of legal issues by unskilled or overburdened staff can be detrimental to a landlord's case.  These problems can even result in loss of the lawsuit and a judgment against the landlord for the tenant's attorneys' fees. If the lease has an attorneys' fees clause, the losing party is liable for the winner's fees.  Thus, it is important to avoid case-losing mistakes.
•       All legal documents necessary to prepare and prosecute the unlawful-detainer case are quickly processed by e-mail or fax.  No need to travel to the attorney's office. 
•      Ms. Shelton will prepare the 3-day notice to pay rent or quit, or the 30-day or 60-day notice to quit, when a tenant has not defaulted in rent; or a 3-day notice to quit when a purchaser has taken title to foreclosed or short-saled property, and the owner will not vacate, and a 90-day notice to quit to his tenants.  Ms. Shelton then prepares  the lawsuit, obtains a default when the tenants fail to answer, and obtains a writ of possession.  The writ is the court order which permits the Sheriff to evict the tenants.  
  
•      In a default case, a writ of possession can be obtained within about 2 weeks from the date the unlawful-detainer lawsuit is served on the defendant, depending on the particular court.  The sheriff will then take about 10 days to lock out the defendant.  His fee is $125.
  
•      In contested cases, the case will be set for trial by the court within about 20 days from the landlord's request for a trial. Contested cases are more costly than defaults.
•     If the tenants file a bankruptcy petition to stall the eviction, Ms. Shelton will move to obtain relief from the automatic stay from the bankruptcy court.
